Terms of Service
These terms govern your use of Pickkapp, an AI phone-receptionist service operated by Blue Briar Projects, India ("we", "us"). By creating an account you agree to them.
1. The service
Pickkapp answers phone calls on your behalf using an AI assistant, takes messages, and shows you who called and why. The assistant is an AI: it is designed to be accurate and helpful, but it can mishear, misunderstand, or summarise imperfectly. You should not rely on it for emergency calls or for conversations where an error would cause serious harm.
2. Your account
- Your mobile number is your identity. Keep your login PIN private; you're responsible for activity on your account.
- You must be 18+ and use the service for lawful purposes only.
3. Plans, minutes and billing
- Plans and add-ons are prepaid and billed for 30-day cycles from the date of purchase.
- Call time is counted in whole minutes (a 45-second call counts as 1 minute). Detected spam calls are not billed.
- When your minutes run out, the assistant stops answering until you top up. We notify you before and when this happens.
- Prices are listed in the dashboard and may change; changes never apply retroactively to time you've already paid for.
4. Call recording
Call recording is included free on every plan. Recordings are retained for 90 days on our servers (you may download them to your own device at any time; you may also choose a shorter retention window of 30 or 60 days). On business plans the assistant discloses that the call may be recorded; on the Personal plan, recording is done on your behalf as a party to your own calls under India's one-party-consent position. Outbound calls placed by the assistant (booking confirmations, reminders) are not recorded. You are responsible for ensuring that recording calls is lawful for your business and use case.
5. Acceptable use
You may not use Pickkapp to harass, defraud, impersonate others unlawfully, violate telecom regulations, or handle calls you have no right to receive. We may suspend accounts that abuse the service or create risk for other customers.
6. Trials, referrals and Partner Profit
- A normal eligible signup receives a 14-day Personal Assistant trial. An eligible first-time signup using a valid referral link or code receives 21 days. One person/customer is eligible for one trial; creating additional accounts, locations, add-ons or numbers does not create another trial entitlement.
- Referral codes are attribution tools, not cash, discounts or ownership rights. We may reject self-referrals, duplicate identities, abuse, fraud, refunded payments or invalid attribution.
- Approved partners may earn “Partner Profit” for an attributed paying customer: ₹500 for a Personal plan or ₹1,000 for a Front Desk plan per eligible paid billing cycle. One real customer counts once even if they use multiple accounts, locations or add-ons.
- Partner Profit is held for 7 days after the customer payment, is available for up to 24 paid cycles, and stops after three consecutive unpaid billing cycles. A ledger balance is not proof of bank settlement; payment is complete only when Pickkapp records a settlement reference.
- The promotional Partner Profit programme is intended to run for up to two years, but we may suspend new referrals or change future rewards with advance notice. Already earned and verified amounts remain governed by the terms applicable when they were earned.
7. Caller follow-up messages
Where enabled, the assistant may send a caller a WhatsApp acknowledgement after a genuine call, identifying itself as the account owner's AI assistant, confirming that the call or message was received, and including an optional Pickkapp trial link. Delivery depends on WhatsApp availability and approved templates. We do not promise that every message will be delivered.
8. Availability & liability
We aim for the service to be available continuously but do not guarantee uninterrupted operation — telephony, AI, and network providers we depend on can have outages. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose. We are not liable for indirect losses (lost business, lost profits) arising from missed, dropped, or mishandled calls.
9. Ending things
You can stop using Pickkapp at any time; simply disable the assistant and remove call forwarding from your carrier. We may terminate accounts that violate these terms. See our Refund Policy for what happens to unused amounts.
10. Governing law
These terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts of Delhi, India.
